Terms and Conditions for Overnight Stay
- (Scope of application)
Article 1 The accommodation contract and related contracts that our hotel enters into with the guest to stay shall be subject to these terms and conditions. Any matters not provided for in these terms and conditions shall be governed by laws and regulations (laws or regulations or any agreements based on laws and regulations).same as below.) or in accordance with generally established practice.
2. In the event that the Hotel enters into a special agreement with a Guest, provided such special agreement does not violate laws, regulations or customary practices, the special agreement shall take precedence over the provisions of the preceding paragraph.
(Application for accommodation contract)
Article 2 Anyone who wishes to apply for an accommodation contract with this facility must provide the following particulars to this facility.
(1) Name of guest
(2) Date of stay and expected time of arrival
(3) Accommodation fees(In principle, the basic accommodation fee is as specified in Schedule 1.)
(4) Any other matters deemed necessary by the Embassy.
2. If a guest requests to extend their stay beyond the date specified in paragraph 2 of the previous article, the facility will treat this as an application for a new accommodation contract at the time the request is made.
(Establishment of accommodation contract, etc.)
Article 3 The accommodation contract will be concluded when the hotel accepts the application under the previous article.However, this does not apply if the hotel can prove that it did not consent.
2. When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the hotel, up to the basic accommodation fee for the period of stay (if it exceeds 3 days, for a period of 3 days), shall be paid by the date specified by the hotel.
3. The application fee shall first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remainder, if any, shall be refunded at the time of payment of the fees as provided for in Article 12.
4. If the application fee stipulated in paragraph 2 is not paid by the date specified by the Hotel in accordance with the provisions of the same paragraph, the Accommodation Contract will become void.However, this will only apply if the hotel has so informed the guest when specifying the due date for payment of the application fee.
(Special agreements that do not require payment of a deposit)
Notwithstanding the provisions of Article 4, Paragraph 2, this facility may enter into a special agreement stipulating that the application fee stipulated in the same paragraph shall not be required after the contract is concluded.
2. If, when accepting an application for an Accommodation Contract, the Hotel has not requested the payment of the application fee as set forth in Paragraph 2 of the preceding Article and has not specified a due date for the payment of the application fee, it will be treated as if the Hotel had accepted a special contract as set forth in the preceding Paragraph.
(Refusal to enter into an accommodation contract)
Article 5 This facility may not accept the conclusion of an accommodation contract in the following cases.However, this does not mean that the hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns and Hotels Act.
(1) When an application for accommodation does not conform to these terms and conditions.
(2) When the hotel is fully booked and there are no guest rooms available.
(3) When a person seeking accommodation is deemed to be in danger of engaging in conduct that will violate the provisions of the law, the public order, or good morals in regard to his/her accommodation.
(4) When the person seeking accommodation is deemed to fall under any of the following items (a) to (c):
(a) An organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Activities by Organized Crime Groups (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group").), a member of an organized crime group as defined in Article 2, Paragraph 6 of the same Act (hereinafter referred to as a "member of an organized crime group").),Associate members of organized crime groups or people related to organized crime groups or other antisocial forces
(b) When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
(c) A corporation in which any of its directors is a member of an organized crime group.
(5) When a person seeking accommodation behaves in a manner that causes significant nuisance to other guests.
(6) If the person seeking accommodation is a patient of a specific infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inns and Hotels Act (hereinafter referred to as a "patient of a specific infectious disease")) when
(7) When violent demands are made regarding lodging or when an unreasonable burden is requested (when a person seeking lodging is subject to the provisions of the Act on Promotion of Elimination of Discrimination against Persons with Disabilities (Act No. 65 of 2013)).Hereinafter referred to as the "Act on Elimination of Discrimination against Persons with Disabilities.") This does not apply when seeking the removal of social barriers pursuant to the provisions of Article 7, paragraph 2 or Article 8, paragraph 2.)
(8) When a person seeking accommodation repeatedly makes requests of the facility that are deemed to be excessively burdensome and likely to significantly impede the provision of accommodation-related services to other guests, as specified in Article 5-6 of the Enforcement Regulations of the Inns and Hotels Act.
(9) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
(10) When the case falls under the provisions of Article 4, Paragraphs 1 and 2 of the Kanagawa Prefecture Hotel and Inn Business Act Enforcement Ordinance.
(Explanation for refusal to enter into an accommodation contract)
Article 5-2 If the facility does not agree to enter into an accommodation contract based on the preceding article, a Person seeking accommodation may request an explanation of the reason.
- (Guest's Right to Cancel Accommodation Contract)
Article 6 Guests may cancel the accommodation contract by notifying this facility.
2. This facility shall not accept any cancellation of the accommodation contract in whole or in part due to reasons attributable to the guest (except when the hotel has designated a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2, and the guest cancels the accommodation contract prior to payment).) will be subject to a penalty as set forth in Schedule 2.However, in cases where the hotel has entered into a special agreement as provided for in Article 4, Paragraph 1, this will only apply if the hotel has notified the guest of his/her obligation to pay a penalty when the guest cancels the accommodation contract.
3. If a guest does not arrive by 8 p.m. on the day of their stay without contacting this facility (or one hour after that time if the guest has stated their arrival time in advance), this facility may consider the accommodation contract to have been cancelled by the guest.
(Right to cancel facility contract)
Article 7 This facility may cancel the accommodation contract in the following cases.However, this does not mean that the hotel may refuse accommodation in cases other than those listed in Article 5 of the Travel Agency Act.
(1) When the guest is deemed to be in danger of engaging in conduct that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation, or when he/she is deemed to have engaged in such conduct.
(2) When the guest is deemed to fall under any of the following items (a) to (c):
B. Organized crime,Organized crime,Associate members of organized crime groups or people related to organized crime groups or other antisocial forces
(b) When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
(c) A corporation in which any of its directors is a member of an organized crime group.
(3) When the guest behaves in a manner that causes significant nuisance to other guests.
(4) When the guest is a patient of a specific infectious disease.
(5) When violent demands are made in relation to the accommodation or when an unreasonable burden is requested (except when the guest requests the removal of social barriers as provided for in Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Disability Discrimination Elimination Law).)
(6) When a guest repeatedly makes requests of the facility that are deemed to be excessively burdensome and likely to significantly impede the provision of accommodation-related services to other guests, as specified in Article 5-6 of the Inns and Hotels Act Enforcement Regulations.
(7) When it is impossible to provide accommodation due to a natural disaster or other force majeure.
(8) When the case falls under the provisions of Article 4, Paragraphs 1 and 2 of the Kanagawa Prefecture Hotel and Inn Business Act Enforcement Ordinance.
(9) Smoking in bed, tampering with firefighting equipment, and other prohibited activities set forth in the Hotel Usage Regulations (limited to those necessary for fire prevention purposes) are prohibited.) when not followed.
2. When the hotel cancels the accommodation contract in accordance with the provisions of the preceding paragraph, the hotel will not charge the guest for any accommodation services etc. that he/she has not yet received.
(Explanation of accommodation contract cancellation)
Article 7-2 If the facility cancels the accommodation agreement in accordance with the preceding article, the guest may request an explanation of the reason.
(Accommodation Registration)
Article 8 Guests will be required to register the following particulars at the front desk of this Facility on the day of their stay:
(1) Name of the guest,Address and contact details
(2) For foreign nationals not residing in Japan, their nationality and passport number
(3) Any other matters deemed necessary by the Embassy.
2. If the Guest intends to pay the charges under Article 12 by any means other than currency, such as traveller's cheques, accommodation coupons or credit card, these shall be presented in advance at the time of registration under the preceding paragraph.
(When the guest room is in use)
Article 9 Guests may use the guest rooms of this facility from 3:00 p.m. to 10:00 a.m. the following morning.However, if you are staying for consecutive nights, you may use the room all day except on the days of arrival and departure.
2. Notwithstanding the provisions of the preceding paragraph, this facility may accommodate the use of guest rooms outside the hours specified in the same paragraph.In this case, the following additional fees will be charged:
(1) Up to 3 hours beyond the limit: 1/3 of the room rate
(2) Up to six hours beyond the limit: half the room rate
(3) For stays of 6 hours or more, the full room rate will be charged.
(3. The room charge in the preceding paragraph shall be 70% of the basic accommodation fee.)
(Observance of the rules of use)
Article 10 Guests must abide by the usage regulations established by the hotel and posted within the facility.
- (Opening Hours)
Article 11 The opening hours of the main facilities of this Facility shall be as follows. Detailed opening hours of other facilities shall be provided in the pamphlets provided, on notices posted in various locations, and in the information provided in the guest rooms, etc.
(1) Front desk/cashier service hours
B. Curfew: 11:00 PM
B. Front Desk Service: Until 8pm
(2) Food and beverage (facility) service hours
B. Breakfast: 7:30AM to 9:00AM
B. Lunch: No
Dinner: 6pm to 8pm
2. The hours mentioned in the preceding paragraph may be subject to temporary change in unavoidable circumstances.In such cases, we will notify you by appropriate means.
(Payment of fees)
Article 12 The breakdown of the accommodation fees, etc. to be paid by the guest shall be as set forth in Attached Table 1.
2. Payment of accommodation fees, etc. as stated in the preceding paragraph shall be made at the front desk at the time of the guest's departure or upon request by our hotel in currency or by traveller's cheques, accommodation vouchers, credit cards or other means acceptable to our hotel.
3. Accommodation fees will be charged even if the Guest voluntarily does not stay in the accommodation facility after the Hotel has provided the Guest with a guest room and made it available for use.
(Responsibilities of the Facility)
Article 13 If this facility causes damage to a guest in the fulfillment or non-fulfillment of the accommodation contract and related agreements, the facility will compensate for said damage.However, this does not apply when the cause is not attributable to the Facility.
2. This facility is covered by hotel liability insurance to deal with the unlikely event of a fire or other incident.
(Handling when contracted rooms cannot be provided)
Article 14 When the facility is unable to provide a guest with a contracted room, it will, with the guest's consent, arrange for the guest to stay in accommodation of the same standard elsewhere wherever possible.
2. Notwithstanding the provisions of the preceding paragraph, if this facility is unable to arrange other accommodations, it will pay the guest a compensation fee equivalent to the penalty charges, which will be applied to the amount of damages.However, if the inability to provide a guest room is due to reasons not attributable to this facility, no compensation will be paid.
(Handling of consigned items)
Article 15: In the event that damage such as loss or breakage occurs to goods, cash or valuables deposited by a guest at the front desk, the facility will compensate for such damage, except in cases where this is due to acts of God.However, with regard to cash and valuables, if the hotel requests that the guest disclose the type and value of the items and the guest fails to do so, the facility will compensate for the damage up to a maximum of 500,000 yen.
2. If a guest suffers loss, damage or other injury due to the intentional or negligent act of the facility with respect to goods, cash or valuables brought into the facility but not deposited at the front desk, the facility will compensate for the damage.However, for items for which the guest has not previously notified the guest of the type and value, the facility will compensate for damages up to a maximum of 200,000 yen, except in cases where the facility has acted intentionally or with gross negligence.
(Storage of Guest's Baggage and Belongings)
Article 16 If the baggage of a guest arrives at the facility prior to the guest's stay, the hotel will store it responsibly only if the hotel has agreed to this in advance of the guest's arrival, and will hand it over to the guest at the front desk when the guest checks in.
2. If a guest's baggage or belongings are found left behind at the facility after checking out, and the owner is identified, the facility will contact the owner and request instructions.However, if there is no instruction from the owner or if the owner cannot be identified, the item will be kept for seven days, including the day it was found, and then turned over to the nearest police station.
3. The Facility's liability for the custody of the Guest's baggage and personal belongings in the cases of the previous two paragraphs shall be in accordance with the provisions of the preceding Article, Paragraph 1 in the case of the previous paragraph, and in accordance with the provisions of the same Article, Paragraph 2 in the case of the previous paragraph.
(Parking Responsibility)
Article 17 When a Guest uses the parking lot of this Facility, regardless of whether the vehicle key is deposited with the Facility, this Facility is merely lending the space and is not responsible for the management of the vehicle.However, if any damage is caused intentionally or negligently by the facility in managing the parking lot, the facility will be liable for compensation.
(Liability of the Guest)
Article 18 If the hotel suffers damage due to the guest's willful misconduct or negligence, the guest shall compensate the facility for such damage.
